Patchcord ist kostenlos, privat und beruflich.
Eine Pro-Lizenz gilt für eine Person auf allen eigenen Macs, dauerhaft.
Alle Updates für Patchcord 1.x sind inklusive.
Den Lizenzschlüssel bitte nicht weitergeben oder veröffentlichen.
Den Kauf wickelt Stripe als Verkäufer ab; dort gelten Rechnung, Zahlung und Widerruf.

1. Geltungsbereich

Diese Bedingungen regeln die Nutzung der Software Patchcord einschließlich der Treiber „Patchcord Mic“ und „Patchcord Camera“ (zusammen „Patchcord“) in der kostenlosen Version und als Patchcord Pro. Anbieter ist Zielke Studio, Marburg (Angaben im Impressum auf zielke.studio).

Patchcord Pro wird über Stripe verkauft (Stripe Managed Payments). Verkäufer und Vertragspartner für Kauf, Zahlung, Rechnung, Gewährleistung aus dem Kauf und Widerruf ist Stripe; dafür gelten die beim Kauf angezeigten Bedingungen von Stripe. Diese Lizenzbedingungen regeln, wie du die Software nutzen darfst.

2. Kostenlose Nutzung und Testzeitraum

Du darfst Patchcord kostenlos und zeitlich unbegrenzt privat und beruflich nutzen. Nach der Installation kannst du die Pro-Funktionen 7 Tage lang kostenlos testen. Danach stehen sie nur mit einer Pro-Lizenz zur Verfügung; die übrigen Funktionen und deine Einstellungen bleiben erhalten.

3. Patchcord Pro

Mit dem Kauf erhältst du ein einfaches, nicht übertragbares, zeitlich unbegrenztes Recht, die Pro-Funktionen zu nutzen. Die Lizenz gilt für eine natürliche Person auf allen Macs, die diese Person selbst nutzt, privat wie beruflich. Nutzen mehrere Personen in einem Unternehmen oder einer Organisation Patchcord Pro, braucht jede Person eine eigene Lizenz.

4. Updates

Die Lizenz umfasst alle Updates der Hauptversion 1 (1.x). Eine spätere neue Hauptversion kann kostenpflichtig sein; deine Lizenz für 1.x bleibt davon unberührt. Einen Anspruch auf bestimmte künftige Funktionen gibt es nicht.

5. Lizenzschlüssel

Der Lizenzschlüssel ist persönlich. Du darfst ihn nicht veröffentlichen, an Dritte weitergeben oder verkaufen. Wird ein Schlüssel nachweislich öffentlich verbreitet, können wir ihn in künftigen Versionen sperren; in diesem Fall melde dich bitte, wir finden eine Lösung.

6. Was nicht erlaubt ist

die Lizenzprüfung zu umgehen oder Werkzeuge dafür zu verbreiten,
Patchcord oder veränderte Fassungen weiterzuverkaufen oder als eigenes Produkt zu verbreiten,
Patchcord zu dekompilieren oder zurückzuentwickeln, soweit das nicht gesetzlich erlaubt ist (z. B. § 69e UrhG).

7. Plugins und Software Dritter

Audio-Unit-Plugins wie Antinode Clear sind Produkte anderer Hersteller und unterliegen deren Lizenzen. Patchcord enthält Open-Source-Komponenten, deren Lizenzen unten aufgeführt sind und unberührt bleiben.

8. Haftung

Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper oder Gesundheit sowie nach dem Produkthaftungsgesetz. Bei leicht fahrlässiger Verletzung einer wesentlichen Pflicht, deren Erfüllung die ordnungsgemäße Nutzung erst ermöglicht und auf die du vertrauen darfst, ist die Haftung auf den vorhersehbaren, typischen Schaden begrenzt. Im Übrigen ist die Haftung für leichte Fahrlässigkeit ausgeschlossen. Für die kostenlose Nutzung haften wir nur für Vorsatz und grobe Fahrlässigkeit.

Patchcord greift tief ins Audiosystem ein. Bitte prüfe vor wichtigen Calls, ob Ton und Bild wie gewünscht ankommen.

9. Daten

Die Lizenzprüfung läuft offline auf deinem Mac; Patchcord sendet dafür keine Daten. Für Ausstellung und Versand des Lizenzschlüssels speichern wir Name, E-Mail-Adresse und Kaufdatum. Patchcord fragt täglich auf unserem Server nach Updates; dabei werden wie bei jedem Webseitenaufruf IP-Adresse und App-Version übertragen und nur anonym als Statistik ausgewertet. Zahlungsdaten verarbeitet ausschließlich Stripe.

10. Schlussbestimmungen

Es gilt deutsches Recht. Bist du Verbraucher, bleiben die zwingenden Verbraucherschutzvorschriften des Staates, in dem du lebst, unberührt. Sollte eine Bestimmung unwirksam sein, bleiben die übrigen wirksam.
